You may need to file federal Form 1040-NR instead of Form 1040 if you meet any of the following conditions:

  • Are a nonresident alien individual engaged in a trade or business in the United States during the tax year.
  • Are a nonresident alien individual who is not engaged in a trade or business in the United States and has U.S. income on which the tax liability was not satisfied by the withholding of tax at the source.
  • Are a nonresident alien individual wanting to claim a of excess withholding or the benefit of any deductions or credits (for example, if you have income from rental property that you choose to treat as income connected to a trade or business).
  • Represented a deceased person who would have had to file Form 1040-NR.
  • Represented an estate or trust that had to file Form 1040-NR.

Yes, to file Form 1040-NR instead of Form 1040, complete the following steps:

  1. On the Name & Address menu, select I am filing a 1040-NR from the Resident State selection list.
  2. Click Federal Taxes > Review > I’d like to see the forms I’ve filled out or search a form.
  3. In the search bar, search “Form 1040NR.”
  4. Click Add form beside Form 1040NR – Nonresident Alien Tax Return.
  5. Once you have added the form, fill it out according to your situation, then click Save at the bottom of the screen.
  6. If you need any other 1040-NR related forms, they can be added by searching “1040NR” in that same search box.
