Overview
The Kansas Homestead or Property Tax Relief Claim is a state-sponsored program designed to provide financial assistance to eligible homeowners or renters by refunding a portion of the property taxes or rent paid on their principal residence. The goal is to ease the property tax burden on qualifying individuals, particularly those with limited income.
Kansas offers two distinct property tax relief programs for residents:
Homestead Refund Claim (K-40H)
This program provides a refund to eligible homeowners or renters based on property taxes paid on their primary residence.
Eligibility Criteria:
- You must be a Kansas resident all the tax year.
- Your total household income must not exceed $37,750 (2024 limit, subject to change annually).
- You must meet one of the following conditions:
- Be age 55 or older before January 1 of the filing year.
- Be totally and permanently disabled or blind during the tax year.
- Have a dependent child under age 18 who resided with you the entire year.
Benefit:
- Refunds can be up to $700 depending on income and property tax amount.
- The program is not a credit against income tax but a direct refund.
Property Tax Relief Claim for Seniors (K-40PT)
Often referred to as the “Safe Senior” program, this option is intended for low-income seniors.
Eligibility Criteria:
- You must be age 65 or older before January 1 of the filing year.
- Your household income must be $23,700 or less (2024 limit).
- You must own and occupy the home as your primary residence.
Benefit:
- This claim refunds 75% of the property taxes paid on your home.
- However, any refund received reduces your Homestead refund if you also qualify for K-40H.
Important Information
- You cannot claim both the Homestead Refund and the Property Tax Relief Claim for Seniors in full. If eligible for both, you will receive the higher of the two benefits, but not in full.
- Renters are only eligible for the K-40H, not K-40PT.
- Refunds are typically issued by check or direct deposit within several weeks of processing.
Add Tax Relief Claim
To add the Tax Relief Claims:
- Go to the State taxes section.
- Select I’d like to see the forms I’ve filled out or search for a form.
- In the drop list, select Kansas.
- Select the General tab.
- Select Homestead Claim/Property Tax Relief Claim to add and open the form.
- Complete the form with your applicable information.
- Click Save to apply changes.
