Overview
If you received a West Virginia Schedule EK-1 from a partnership (Form 1065), S corporation (Form 1120-S), or estate/trust (Form 1041), you must enter that information on your West Virginia state return. This is done through the WV – EK1 (1065, 1120S, or 1041 EK1 Received) form.
What Is West Virginia EK1?
The Schedule EK-1 is West Virginia’s equivalent of the federal Schedule K-1. It reports your share of income, deductions, credits, and other pass-through items from:
- Partnerships (Form 1065)
- S Corporations (Form 1120-S)
- Estates and Trusts (Form 1041)
This information must be included on your WV IT-140 Individual Income Tax Return to ensure your state tax liability is calculated correctly.
Who Needs to File an EK1?
You should complete the WV – EK1 Received form if:
- You received a Schedule EK-1 from a partnership, S corporation, or estate/trust that does business in West Virginia.
- You need to report your share of West Virginia-source income, credits, or other adjustments.
- You are a resident or nonresident taxpayer with income attributable to WV.
How to Report
- Navigate to the State Taxes section on the left-hand side of the screen.
- Click the link: “I’d like to see the forms I’ve filled out or search for a form.”
- In the dropdown menu, select West Virginia.
- Click on the K1 tab.
- Click on “EK1 – 1065, 1120S, or 1041 EK1 Received” to open the form.
- Enter all applicable information.
- Click ‘Save‘ once complete.
