Form 1310 – Explanation and FAQs

Overview

Form 1310 is used to claim a tax on behalf of a taxpayer who passed away during the tax year. Officially titled the “Statement of Person Claiming Refund Due a “, this form is a critical part of the final tax filing process for deceased individuals when someone other than a surviving is involved.

When Form 1310 Is Required

Form 1310 must be filed if you are not the surviving spouse and you are claiming a refund for a deceased taxpayer. Common filers include:

  • Court-appointed personal representatives
  • Executors or administrators of the estate
  • Other individuals who are entitled to the refund

You will need to complete the following entries on the Name and Address screen before adding Form 1310.

  • The decedent’s demographic information
  • The date of death for the decedent.
  • On the “In Care Of” line, enter your name, as the person filing on behalf of the deceased.

How to Add Form 1310

To add Form 1310 to your return:

  1. Go to the Federal taxes section.
  2. Click on the Review tab on the left-hand side.
  3. Select I’d like to see the forms I’ve filled out or search for a form.
  4. In the search box, enter Form 1310.
  5. Fill in the applicable information.
  6. Click Save to apply changes.

How to Include the Death Certificate

To attach a PDF to a return:

  1. Click on Federal Taxes on the left-hand side.
  2. Select Review.
  3. Click the I’d like to see the forms I’ve filled out or search for a form link
  4. Go to the General Tab
    • Scroll to the bottom of the screen and find the Electronic Filing and Banking section
    • Select PDF
    • Enter the Reference Source, Description, and File Name. Make sure the file name ends with .PDF
    • Click Save
  5.  Select Attach Now
  6.  Click on the paper clip to the right of the file name to drop, or click on the drop area to browse for the PDF being attached.
  7.  Select Continue to finish return
