Form 8958 – Income Allocation for Community Property States

Taxpayers use this form to determine the allocation of tax amounts between married filing separate spouses or registered domestic partners (RDPs) with community property rights.

This worksheet is a required document for taxpayers who file separately from their and whose address is located in a ‘Community Property’ state. Currently, those states include:

  • AZ (Arizona)
  • CA (California)
  • ID (Idaho)
  • LA (Louisiana)
  • NV (Nevada)
  • NM (New Mexico)
  • TX (Texas)
  • WA (Washington)
  • WI (Wisconsin)

The worksheet is also for any registered domestic partners (RDP) in NV, WA, or CA filing separately from their partner.

Add Form 8958

To add the Form 8958:

  1. Go to Federal Taxes.
  2. Click Review.
  3. Click I’d like to see the forms I’ve filled out or search for a form.
  4. Enter Form 8958 in the search box and click on Form 8958 – Income Allocation for Community Property States to add and open the form.
  5. Enter your information and click Save.
