Overview
Form 965-E is used to formally document the consent of all relevant parties to be jointly and severally liable for the outstanding net tax liability under section 965(i), in the event of a triggering event.
Specifically, it is used when:
- A triggering event occurs that ends a taxpayer’s deferral of the transition tax liability under section 965(i) (e.g., certain transfers or distributions involving S corporations).
- The taxpayer elects to continue deferring payment of the liability under section 965(i) following the triggering event, by having a qualified successor entity or person assume the liability.
- All involved parties (e.g., the transferor and transferee) agree to be jointly and severally liable for the tax.
Add Form 965-E
To add the Form 965-E:
- Go to Federal Taxes.
- Click Review.
- Click I’d like to see the forms I’ve filled out or search for a form.
- Enter Form 965-E in the search box and click on Form 965 – E Consent Agreement Under Section 965(i)(4)(D) to add and open the form.
- Enter your information and click Save.
