Overview
Form N-356 is used to calculate and claim the Hawaii Earned Income Tax Credit, which is equal to 40% of the federal Earned Income Credit (EIC) claimed on your federal income tax return.
The Hawaii EITC is refundable, meaning if the credit exceeds your Hawaii tax liability, the excess amount will be issued as a refund. In most cases, unused credits may be carried forward to future years, with one exception: credits from tax years 2018 through 2021 cannot be carried forward beyond 2024.
To qualify, you must meet the following requirements:
- You filed a federal tax return and claimed the Earned Income Credit under IRC § 32.
- You filed a Hawaii income tax return (Form N-11 or Form N-15) using the same filing status and dependents as reported on your federal return.
